Planning Board · Meeting of October 27, 2026
BELCHERTOWN — The Belchertown Planning Board voted unanimously to recommend the Zoning Board of Appeals uphold a finding that a South Main Street daycare operation does not qualify for a Dover Amendment agricultural exemption. The board revised draft language to specify the exemption applies only to land used for the "primary purpose" of commercial agriculture and to note the Dover Amendment treats daycare and educational corporations as legally distinct categories, citing Massachusetts General Law Chapter 15D, Section 1A. The board also approved two Approval Not Required subdivision plans, one consolidating three Alden Avenue lots for applicants Thomas Mitchell and Peter Gilbert, another adjusting frontage on an Amherst Road parcel for applicant Ronald Leclerc.
Members continued discussion toward drafting an 18-month moratorium on large data centers, floating a half-megawatt peak-consumption threshold while awaiting model regulations from the Pioneer Valley Planning Commission. Town Planner Doug Albertson reported a Woodland Lane subdivision developer has not responded to requests for a written remediation plan after flooding damaged detention basins.
