The commission voted 5-0 Thursday to approve an order of conditions for Christopher and Charlotte Collins at 162 Main Street in Leeds, a single-family property sitting entirely within riverfront area and floodplain on an island in the Mill River, where several project elements had already been built before the owners fully understood jurisdictional requirements. Civil engineer Chris Chamberlain of Berkshire Design Group argued the work was permittable in retrospect and that the applicants' five years of hand-pulling Japanese knotweed across roughly 1,500 square feet of a 6,000-square-foot monoculture constituted meaningful mitigation.

Commissioner Downey, citing Harvard Forest research, proposed enlisting the Collinses as "citizen scientists" to test American black elderberry cuttings against knotweed regrowth in a 1,500-square-foot test plot over five years, with annual documentation of methods and survival rates reported back to the commission. The commission also voted 5-0 to issue a negative determination for loading dock alterations at 525 Mount Tom Road for Packaging Corporation of America, conditioned on resolving a 1999 order of conditions within six months, and 5-0 to approve a conservation restriction on the Mineral Hills South property in favor of Kestrel Land Trust.
